1. How to conclude the contract with SOLARIS SPORT

To conclude the purchase contract for one or more products on solarissport.com, you must fill out the order form in electronic format and send it to SOLARIS SPORT, electronically, following the relevant instructions. The order form contains a summary of the General Conditions of Sale, information on the essential characteristics of each product ordered and the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product and the delivery methods of the purchased products, shipping and delivery costs, the conditions for exercising your right of withdrawal and the methods and times for returning the purchased products. The contract is concluded when SOLARIS SPORT receives, electronically, your order form, after verifying the correctness of the data relating to your order.

Before proceeding with the purchase of products, by sending the order form, you will be asked to carefully read the General Conditions of Sale, and confirm acceptance by selecting the corresponding field. The order form will be stored in our database for the period of time necessary to process the orders and in any case within the terms of the law. Before proceeding with the transmission of the order form, you will also be asked to identify and correct any errors in data entry. Once the contract has been concluded, SOLARIS SPORT will take charge of your purchase order. SOLARIS SPORT may not process your purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. In these cases, we will inform you by email that the contract has not been concluded and that SOLARIS SPORT has not followed up on your purchase order, specifying the reasons.

If the products presented on solarissport.com are no longer available or on sale at the time of your last access to the site or when you send the order form, SOLARIS SPORT will promptly inform you and in any case within thirty (30) days from the day after you sent your order to SOLARIS SPORT, of the unavailability of the products ordered. In the event of forwarding the order form and payment of the price, SOLARIS SPORT will refund the amount you have already paid. By electronically transmitting the order form, you unconditionally accept and undertake to observe, in your dealings with SOLARIS SPORT, these General Conditions of Sale. If you do not agree with some of the terms set out in the General Conditions of Sale, we invite you not to forward the order form for the purchase of products on solarissport.com. By submitting the order form, you confirm that you know and accept the General Conditions of Sale and the additional information contained in solarissport.com, also referred to via links, including the General Conditions of Use and Privacy Policy. Once the contract has been concluded, SOLARIS SPORT will send you, by email, a receipt of the purchase order, containing a summary of the information already contained in the order form (General Conditions of Sale, information relating to the essential characteristics of the product and detailed indication of the price, payment methods, your right of withdrawal and delivery costs).

2. Guarantees and indication of product prices

On solarissport.com only original and quality products are offered for sale. These products are purchased directly by SOLARIS SPORT from manufacturers and retailers carefully selected for their rigorous quality controls. SOLARIS SPORT does not sell used, irregular or lower quality products than the corresponding standards offered on the market. The essential characteristics of the products are presented on solarissport.com within each product sheet. The images and colors of the products offered for sale on solarissport.com may however not correspond to the real ones due to the Internet browser and monitor used.

Product prices may be subject to change. Make sure of the final sale price before submitting the relevant order form. SOLARIS SPORT, in the event of exercising your right of withdrawal, has the right to not accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged.

3. Payments

To pay the price of the products and the related shipping costs, you can follow one of the methods indicated in the order form. In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will be collected, via SSL (Secure Socket Layer) encrypted protocol, by Cartasi, supplier of the related remote electronic payment services, without third parties being able to access them in any way. The information relating to the credit card will never be viewed by SOLARIS SPORT. Only the information relating to the payment will be used by SOLARIS SPORT only to complete the procedures relating to your purchase and to issue the related refunds in the event of any returns of the products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report to the police the commission of fraud on solarissport.com. The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to your credit/debit card at the time of shipment of the purchased products.

4. Shipping and delivery of products

Please pay attention to what is reported in this section because the information contained therein forms an integral and substantial part of these General Conditions of Sale and, therefore, are considered to be fully known and accepted by you at the time of transmission of the order form.

6. Right of withdrawal

You have the right to withdraw from the contract concluded with SOLARIS SPORT, without any penalty and without specifying the reason, within thirty (30) days from the day of receipt of the products purchased on solarissport.com. The return is free. To withdraw from the contract, fill out the online return form that you can find in the RETURNS section, in the SERVICES column of the footer of our site. You will also find the instructions for making the online return in the leaflet that we sent you together with the items you ordered.

Fill out the online form, selecting the items you wish to return and send us the request. solarissport.com will immediately send you an email with the return number. You will then be notified of the day on which the TNT courier will pick up the goods you wish to return. If you decide not to use the free return service, or if 30 days have elapsed from the date of purchase, send the goods at your own expense to the following address:

Before shipping, make sure that the products are in the same condition in which you received them, including shoe boxes, packaging, labels, envelopes and any original instruction booklets. Returns that do not meet all the required conditions will not be accepted: in this case the items will be returned to your address and at your expense. If the Right of Withdrawal is exercised following the methods and terms indicated in this paragraph, SOLARIS SPORT will refund any sums already received for the purchase of the products, net of shipping costs for the delivery of the purchased products. SOLARIS SPORT will refund you, in addition to the sums received for the purchase of the products, also the shipping costs for the delivery of the purchased products, only in the event that the return of the products occurs for reasons attributable to SOLARIS SPORT, such as in the case in which the products do not possess the essential characteristics promised, have manufacturing defects or there have been errors in their delivery. The sums will be refunded to you as soon as possible and, in any case, within thirty (30) days from the date on which SOLARIS SPORT became aware of the exercise of your right of withdrawal, we will activate the refund procedures, once the correct execution of the terms and conditions indicated above has been verified. If the methods and terms for the exercise of your right of withdrawal are not respected, as specified in this paragraph, you will not be entitled to a refund of the sums already paid to SOLARIS SPORT; however, you will be able to obtain, at your expense, the products in the state in which they were returned to SOLARIS SPORT. Otherwise, SOLARIS SPORT may retain the products, in addition to the sums already paid for their purchase.

7. Refund times and methods

After the products have been returned, SOLARIS SPORT will carry out the necessary checks regarding their conformity to the conditions and terms indicated in the previous paragraph. If the checks are concluded positively, SOLARIS SPORT will send you, via email, the relevant confirmation of acceptance of the returned products. Regardless of the payment method used by you, the refund is activated by SOLARIS SPORT within thirty (30) days from the date on which SOLARIS SPORT became aware of the exercise of your right of withdrawal, after checking the correct execution of your right of withdrawal and acceptance of the returned products. The refund will be made using the same payment system used at the time of the order. For cash on delivery, in the online return form, we will ask you to specify the refund method you prefer: Paypal, credit card or bank transfer.

8. Privacy

You can obtain information on how we process your personal data by accessing the Privacy section. We also ask you to read, if you have not already done so, our General Conditions of Use because they contain important information on how we process the personal data of our users and on the security systems adopted. 9. Applicable law and dispute resolution

The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206 on distance contracts and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce. In the event of disputes between SOLARIS SPORT and each end user, arising from the General Conditions of Sale, the competent court is that of Macerata.

10. Modification and update

The General Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on solarissport.com.
